Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Sanctia mobile application and website (the "Service") operated by Sanctia ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Description of Service

Sanctia is a "dead man's switch" service that allows users to compose messages that are automatically delivered to designated recipients if the user fails to respond to periodic check-in notifications. The Service includes:

• A mobile application for iOS and Android
• A web-based dashboard
• Check-in reminder notifications via email, SMS, and push notifications
• Automated message delivery to designated recipients

2. Account Registration

To use certain features of the Service, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account and use the Service.

3. User Responsibilities

As a user of the Service, you agree to:

• Use the Service only for lawful purposes
• Not use the Service to harass, threaten, or harm others
• Not include content in your messages that is illegal, defamatory, obscene, or violates the rights of others
• Keep your check-in settings configured appropriately for your circumstances
• Ensure you have the right to contact your designated recipients
• Not attempt to circumvent security measures or access systems without authorization

4. Message Content

You are solely responsible for the content of any messages you create using the Service. By using the Service, you represent and warrant that:

• You have the right to send messages to your designated recipients
• Your messages do not violate any applicable laws or regulations
• Your messages do not infringe upon the rights of any third party
• Your messages do not contain threats, harassment, or illegal content

We do not pre-screen message content but reserve the right to remove or refuse to deliver content that violates these Terms.

5. Service Availability & Reliability

We strive to provide a reliable Service, but we cannot guarantee 100% uptime or delivery. You acknowledge and agree that:

• The Service may be temporarily unavailable due to maintenance or technical issues
• Message delivery depends on third-party services (email, SMS providers) which may experience delays or failures
• Check-in notifications may be delayed or not delivered due to factors outside our control
• We are not liable for any damages resulting from Service interruptions or delivery failures

Important: This Service is not a substitute for emergency services, medical monitoring, or professional care. Do not rely on this Service for time-critical or life-safety situations.

6. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our data practices.

7. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Sanctia and its licensors. The Service is protected by copyright, trademark, and other laws.

You retain ownership of any content you create using the Service (such as your messages), but you grant us a license to store, process, and transmit that content as necessary to operate the Service.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so by contacting us or using the account deletion feature in the app.

Note: Account termination will prevent any pending messages from being delivered. If you have active recipients configured, please consider their expectations before deleting your account.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that: (a) the Service will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SANCTIA, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Failure or delay in message delivery
• Any other matter relating to the Service

11. Indemnification

You agree to defend, indemnify, and hold harmless Sanctia and its affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws applicable in your jurisdiction, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

14. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
